Four dated changes between June 2025 and the end of 2026 reshaped where the replaceable volume sits. Buyers who read them early are the ones still selling.
Environmental Protection (Single-use Vapes) Regulations 2024. A vape counts as single-use if the battery is not rechargeable or the pod / coil cannot be replaced. Sealed disposables are out; swappable pods are in.
FDA finalised guidance sorting products by regulatory posture: authorised, accepted-and-filed PMTA, and unauthorised with no pending application. Documentation decides your tier — and your border risk.
£2.20 per 10 ml excise on e-liquid, applied to nicotine and non-nicotine alike. Per-pod economics now matter more than per-device price — buyers are re-running their margin sheets.
The Commission's revision is expected to bring nicotine pouches into scope for the first time and tighten flavour and packaging rules. National bans are already live in Belgium and France; the Netherlands restricts flavours to tobacco.

The Regulations treat a vape as single-use if the battery cannot be recharged or the pod / coil cannot be replaced. A rechargeable device with swappable prefilled pods clears both tests. TRPR 2016 limits still apply: nicotine up to 20 mg/ml, pod capacity up to 2 ml, and MHRA notification before the product can be sold.
